Community Meeting – The impact of European regulation

We are pleased to invite you to the upcoming CoE-DSC Community Meeting on 23 September. The session will focus on the impact of European regulation, including the Data Act and FIDA, and the regulatory supervision and enforcement.
Participation is free of charge.

The Data Act (DA) and the supervisory role of ACM
On 12 September, the European Data Act (DA) will come into force. Its objective is to enable businesses, citizens, and public authorities to access and share data that is currently primarily available to manufacturers of the devices generating it, such as usage data from smart devices.

In the Netherlands, the Authority for Consumers and Markets (ACM) will have a central role as regulator. During the Community Meeting, ACM will present its preparations for this responsibility, outline the key provisions of the DA, and explain why collaboration is essential for effective supervision. The relationship with the Dutch Data Protection Authority (AP) will also be briefly discussed.

Insights from the financial sector
The financial sector has long been subject to European data regulations, such as the Payment Services Directive (PSD2), which facilitates the sharing of payment account data. Two additional initiatives are now on the horizon:

  • FIDA (Financial Data Access): A proposal aimed at advancing open finance by regulating broader access to financial data.
  • DORA (Digital Operational Resilience Act): Designed to enhance the digital resilience of financial institutions.

Although FIDA is still under development and DORA has only taken effect in 2025, valuable insights can already be drawn from how data sharing and collaboration between stakeholders and regulators contribute to innovation. This session will highlight practical lessons that are relevant to other sectors as well.
